our philosophy: a good case story is essential, both to settlement positioning and at trial. that story will be told primarily through the witnesses. witness prep must be custom-tailored to allow the witness’ testimony to advance the client’s case story, or at least, to mitigate the risk posed by witnesses with significant shortcomings. emotions are integral to human decision-making. we must concern ourselves not only with what we want the fact finder to think about our side and our case story, but also how they will feel. it's understandable to want to avoid all the messy emotions. that's where we come in – preparing witnesses and developing litigation strategies for the head and the heart. be humble and remain curious. sometimes all the education, insight, and experience will not prepare us for aspects of a case. we must remain open-minded, seeks answers, and never stop learning. meet the witness where they are, then push the envelope, but don't tear through it. never ask a witne
